These terms of sale apply to all sales concluded on https://northmanstyle.com. The site is operated by CHIC AND SHINES (Entreprise individuelle), located at 12 rue de la Paix, 75002 Paris, France, email contact@northmanstyle.com, phone 0690 95 71 57. The site sells new clothing and accessories for men and boys. Validating an order constitutes acceptance of these terms.
1 - Principles
These terms set out the full obligations of the parties. The buyer is deemed to accept them without reservation.
They apply to the exclusion of all other conditions. They are available on Northman Style and prevail over any conflicting version or document.
The seller may amend these terms from time to time. They apply as soon as they are published online. These terms remain valid until 31 December 2040.
2 - Scope
These terms define the rights and obligations of the parties in connection with online sales of goods offered by the seller to the buyer on Northman Style.
They cover purchases made on the site and delivered in mainland France or Corsica. For delivery to French overseas territories or abroad, contact contact@northmanstyle.com.
These purchases concern the following products: clothing and accessories for men and boys.
3 - Pre-contractual information
The buyer acknowledges having received, before placing the order, these terms and the information listed in Article L. 221-5 of the French Consumer Code (essential characteristics, price, delivery costs, time limits, seller identity, legal warranties).
4 - Ordering
The buyer places an order online from the catalogue, subject to stock availability, and will be informed of any unavailability.
To validate the order, the buyer must accept these terms, choose the delivery address and method, then validate the payment method.
The sale is final after the confirmation email and after the full price has been collected.
The seller may block an order in case of non-payment, incorrect address or dispute. Order tracking: 0690 95 71 57 (local call rate), Monday to Friday 9:00-17:00, or contact@northmanstyle.com.
5 - Electronic signature
Providing payment details online and final validation of the order constitute proof of the buyer’s agreement on the sums due and on acceptance of the transactions carried out.
In case of fraudulent use of a payment method, contact the seller immediately at 0690 95 71 57.
6 - Confirmation and evidence
The seller sends an order confirmation by email.
Computerised records kept in the seller’s systems under reasonable security conditions constitute evidence of communications, orders and payments. Order forms and invoices are archived on a reliable durable medium.
7 - Product information
The products covered by these terms are those shown on the site as sold by the seller, subject to stock availability.
They are described as accurately as possible. However, if errors or omissions occur, the seller’s liability cannot be engaged. Photographs are not contractual.
8 - Prices
The seller may change prices at any time but undertakes to apply the rates shown at the time of the order, subject to availability.
Prices are in euros, including VAT, excluding delivery costs shown before validation. Any change in the VAT rate will be reflected.
Free delivery may be offered from a basket threshold (current indicative threshold: 80 €). The amount shown at checkout applies.
9 - Payment methods
This is an order with an obligation to pay. The buyer may use the payment methods available on the site (card via secure providers such as Viva.com or Stripe, PayPal, Scalapay, depending on availability at checkout).
The buyer warrants having the necessary authorisations. The seller may suspend any order or delivery in case of payment refusal, non-payment, or an ongoing payment dispute.
Payment of the full price is due on the day of the order.
10 - Availability, time limits and termination
Except in cases of force majeure or announced closure periods, shipping times run from the order registration date shown in the confirmation email.
For delivery in mainland France and Corsica, the time limit is 10 to 15 days from the day after the order (Colissimo or equivalent). At the latest, delivery will occur within 30 business days after conclusion of the contract.
For French overseas territories or other countries, arrangements are specified case by case.
If the time limit is not met, the buyer must first require the seller to perform within an additional reasonable period, then may terminate the contract under the Consumer Code. Refunds are made within 14 days of termination.
If a product is unavailable, the buyer is informed promptly and may cancel for a refund within 14 days or request an exchange.
11 - Delivery arrangements
Delivery means the transfer to the consumer of physical possession of the goods. Products are delivered to the address on the order form. Any parcel returned due to an incorrect or incomplete address may be reshipped at the buyer’s expense.
If the packaging is damaged, torn or open, the buyer must check the items and, where appropriate, refuse the parcel and note a reservation on the delivery slip.
The buyer must note any anomaly (damage, missing product, damaged parcel) on the delivery slip with handwritten reservations and signature.
These reservations must be confirmed to the carrier no later than two business days after receipt, with a copy to the seller.
12 - Delivery errors
The buyer must notify the seller of any delivery error and/or non-conformity on the day of delivery or no later than the next business day. Claims beyond that period may be rejected.
Claims may be made by phone at 0690 95 71 57 or by email at contact@northmanstyle.com.
In case of delivery error, the product to be exchanged or refunded must be returned in its original packaging to 12 rue de la Paix, 75002 Paris, France. Return costs are then borne by the seller.
13 - Product warranties
The consumer has two years from delivery of the goods to rely on the legal conformity warranty (Articles L. 217-1 et seq. of the French Consumer Code). During that period, the consumer need only establish the existence of the lack of conformity.
The legal conformity warranty entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience.
The consumer also benefits from the legal warranty against hidden defects (Articles 1641 to 1649 of the Civil Code) for two years from discovery of the defect.
A seller who wrongfully obstructs the legal conformity warranty faces the penalties set out in Article L. 241-5 of the Consumer Code.
14 - Right of withdrawal
Under the Consumer Code, the buyer has 14 days from the delivery date to return any item that does not suit them and request an exchange or refund without penalty, except for return shipping costs which remain payable by the buyer.
Returns must be in their original condition and complete (packaging, accessories), allowing resale as new, with the purchase invoice. Damaged, soiled or incomplete products are not accepted.
Withdrawal may be exercised online or by any unambiguous statement. Within the time limit, the price of the products and outbound delivery costs are refunded; return costs remain payable by the buyer.
Exchange (subject to availability) or refund is made within 14 days, and no later than 30 days from receipt of the returned products.
If the product is defective, submit a written statement and a photo proving the defect. The claim must be submitted within 30 days of the delivery date.
Exceptions (Article L. 221-28): goods made to the consumer’s specifications, unsealed goods that cannot be returned for hygiene reasons, goods inseparably mixed with other items, etc.
15 - Force majeure
Any circumstances beyond the parties’ control preventing normal performance of their obligations are treated as grounds for exemption and suspend those obligations (transport blockages, natural disasters, telecommunications network failures, etc.).
If force majeure lasts more than three months, these terms may be terminated by the injured party.
16 - Intellectual property
The website content remains the property of the seller, sole holder of the intellectual property rights. Any total or partial reproduction is strictly prohibited.
17 - Personal data
Personal data provided by the buyer is required to process the order and issue invoices. It may be shared with partners responsible for fulfilment, processing, management and payment of orders.
The buyer has rights of access, rectification, erasure, objection and other GDPR rights under the Privacy Policy. Contact: contact@northmanstyle.com.
18 - Partial invalidity and non-waiver
If one or more provisions are held invalid, the remaining provisions retain full force and effect.
Failure to enforce a breach shall not be construed as a waiver of the obligation concerned.
19 - Headings and language
In case of interpretation difficulty between a heading and a clause, the headings shall be disregarded.
These terms are drafted in French. In case of translation, only the French text prevails.
20 - Mediation and dispute resolution
The buyer should first contact the seller (contact@northmanstyle.com) to seek an amicable solution.
Under Article L. 612-1 of the Consumer Code, every consumer has the right to free consumer mediation. CHIC AND SHINES offers mediation via: Médiation Conso Drôme, 19 Bis Rue Jonchère, 26000 Valence. Website: https://mediation-conso-drome.org/. Phone: +33 (0) 788 825 542.
